Background of the norm
The current regulation is the Order ETU/1033/2017, 25 october, which approves the national allocation of frequencies, as amended by order ETU/416/2018, of 20 april, and by the order ETD/666/2020, of 13 july.
Need and opportunity for approval
The Last world radiocommunication conference of the international telecommunication union (CMR 2019) was held in Sharm el-Sheikh (Egypt), 28 october to 22 november 2019, having adopted all the records that reflected the agreements adopted at the same, including the revisions adopted in the tables of allocation of frequencies, and in the notes by the itu radio regulations.
These changes must be incorporated into the CNAF. you must also incorporate Implementation of Decisions of the european commission as to the radio spectrum, recently published, as well as new decisions of the european conference, Postal and telecommunication (CPT) taken by Spain.
It is also necessary to update some notes of national use (Notes A), in the terms and conditions resulting from its technical harmonization within the european union, and the updating of the conditions of use of certain radio systems and arrangements and incorporation of new applications and uses radio.
Objectives of the norm
The national allocation of frequencies (CNAF) is the document that regulates the use of the radio spectrum by various radio-communications services in the different frequency bands. It is a document that we must maintain updated, especially when relevant changes arising from the a World radiocommunication conference, or it is necessary to incorporate into domestic law Decisions for the use of harmonized frequency bands, adopted at the european Union. The CNAF recolle tamén needs arising from the spanish industry and of the telecommunications sector in general, establishing the conditions of use at the national level.
Possible alternative solutions, regulatory and non-regulatory
The General Directorate of Telecommunications and Audiovisual media services is exploring the possibility of developing a policy initiative on this matter, consisting of a new Ministerial Order to adopt a new version of the national allocation of frequencies, given that the changes and developments, in particular those resulting from the last the itu world radiocommunication conference (CMR- 2019), recent decisions adopted by the european commission, and other national, are very numerous, is considered adequate to publish a new, complete edition of the CNAF, so that, under article 133.1 of law 39/2015, of 1 october, of Common Administrative Procedure of the public administrations and article 26.2 of the law 50/1997, of 27 november, the government, through this public consultation obtains the opinion of the subject and major organisations potentially affected by the future regulation on:
(b) the need and opportunity to its adoption.
(c) the objectives of the rule.
(d) possible alternative solutions regulatory and non-regulatory policies.
