Data Altruism Organisations
Regulation (EU) 2022/868 of the European Parliament and of the Council of 30 May 2022 on European data governance and amending Regulation (EU) 2018/1724 establishes, among other things, a framework for the voluntary registration of entities that collect and process data made available for altruistic purposes.
Data altruism means the voluntary sharing of data on the basis of the consent of data subjects to process personal data pertaining to them, or permissions of data holders to allow the use of their non-personal data without seeking or receiving a reward that goes beyond compensation related to the costs that they incur where they make their data available for objectives of general interest as provided for in national law.
Recognised Data Altruism Organisations
Entities that collect and process data made available for altruistic purposes and meet the requirements laid down in Article 18 of Regulation (EU) 2022/868 may voluntarily apply for registration in a national register of recognised data altruism organisations.
To be registered in the national register of recognised data altruism organisations, an entity must demonstrate compliance with the essential requirements set out in Article 18 of the Regulation, including compliance with the rulebook referred to in Article 22, where such rulebook has been adopted by the Commission.
Registration entitles the entity to use, in its oral and written communications, the designation “Recognised Data Altruism Organisation in the Union”, as well as a common logo to be developed by the European Commission.
Recognised organisations registered in the national registers of recognised data altruism organisations are subject to the supervision and control of the competent authority, and must comply with the general requirements of Article 18 of the Regulation and the rulebook under Article 22, as well as the obligation to notify changes in information under Article 19, the transparency requirements under Article 20, the specific requirements to protect the rights and interests of data subjects and data holders regarding their data under Article 21, and the requirements concerning access and international data transfers under Article 31 of the Regulation.
