Data brokering and data altruism services (DGA Regulation)
On 3 June 2022, the Regulation (EU) 2022/868 of the European Parliament and of the Council of 30 May 2022 on European data governance and amending Regulation (EU) 2018/1724 (Data Governance Act) was published in the Official Journal of the European Union.
The Regulation provides for the establishment of, among other things, a notification and supervisory framework for the provision of data intermediation services and a framework for voluntary registration of entities which collect and process data made available for altruistic purposes.
In this way, the Regulation seeks to promote the exchange of data between sectors and between Member States of the Union by strengthening trust in data sharing, thereby fostering the internal data market and promoting a data-driven economy and society that benefits citizens and businesses.
The provisions of the Regulation apply to data intermediation services providers and data altruism organizations established in the Union, as well as to those not established in the Union but offering their data intermediation services or data altruism services within the Union.
This Regulation has applied since 24 September 2023. However, data intermediation service providers that were already providing such services before 23 June 2022 shall comply with the obligations laid down in Chapter III of this Regulation no later than 24 September 2025.
